Cost transfer

The deliveryman of a Gestion Avisée client sustained a severe injury when his hand was caught in a conveyor belt of the company where he was making a delivery. The accident investigation demonstrated that the conveyor was dangerous and did not respect health and safety requirements. Gestion Avisée requested the transfer of the claim cost due to the negligence of the equipment owner. The request which was initially refused by the New Brunswick Workers Compensation Board was appealed before the Appeals Tribunal which concluded in favor of Gestion Avisée.

As a result, the employer saved more than $100,000 in assessment
